Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and Vladimir Makarevich ("Developer", "we", "us", "our") and govern your access to and use of the Wastime applications and related services, including our mobile applications (iOS and Android) and our web application (collectively, the "Application").
By completing onboarding and affirmatively indicating your agreement (for example, by checking the box that states you have read and agree to the Terms of Service and Privacy Policy and then tapping "Start My Journey" or a similar button), creating an account, purchasing a subscription, or otherwise accessing or using the Application, you agree to be bound by these Terms. If you do not agree, do not use the Application.
These Terms incorporate by reference our Privacy Policy, which explains how we process personal data. Your use of the Application is also subject to the terms of the platform from which you downloaded or access the Application (for example, Apple App Store, Google Play, or a web browser).
Application Description and Features
The Application provides time management, life calendar visualization, and related tools. Features may include:
- Life calendar creation and visualization
- Time tracking and analytics
- Calculators and converters
- Life expectancy estimation features and informational content
- Optional publishing and sharing features
- Optional synchronization across devices (subscription feature)
We may add, remove, or modify features at any time. If you have an active paid Subscription and we materially reduce or remove paid features, you may stop using the Application and cancel your Subscription through your app store. Any refunds are handled by the app store under its policies and applicable law.
Eligibility and Age Restrictions
You must be at least 13 years old to use the Application. If you are under the age of majority in your jurisdiction, you may use the Application only if your parent or legal guardian has reviewed and agreed to these Terms and is responsible for your use.
The Application includes content related to life planning and mortality. If you are under 18, we recommend discussing such content with a parent or guardian.
User Accounts
Some features require an account. When you create an account, you must provide accurate information and keep it up to date. You are responsible for all activity under your account and for maintaining the confidentiality of your credentials.
Authentication may be provided through third-party identity providers (for example, Google, Apple, or Facebook) or email/password authentication. Your use of those providers is subject to their terms.
Required Acceptance: The Application requires you to accept these Terms during onboarding (for example, at first launch or when onboarding completes) as a condition of continued use. If you do not accept, you will not be able to proceed to use the Application.
During onboarding, the Application also requires you to acknowledge a personal responsibility statement (for example, that you take full personal responsibility for your decisions and actions). This acknowledgment is intended to reinforce that the Application is for educational and self-reflection purposes and does not provide professional advice.
We may refuse registration, suspend, or terminate accounts as permitted by applicable law and as described in these Terms.
Subscriptions, Billing, and Payments
The Application may offer free features and paid subscriptions ("Subscriptions") that unlock premium functionality. Subscription options, pricing, and features are presented in the Application and in the applicable app store listing at the time of purchase and may vary by region, currency, taxes, and platform.
App Store Billing: If you purchase a Subscription through Apple App Store or Google Play, the store is the merchant of record and will process your payment. We do not receive or store your payment card details. Your purchase is also subject to the store's terms, including billing, refunds, and cancellations.
No Web Purchases: We currently do not sell Subscriptions directly through the web application (for example, via Stripe, PayPal, or direct card payments). Subscriptions are available only through Apple App Store and Google Play.
Auto-Renewal and Cancellation: Subscriptions typically renew automatically unless canceled before the end of the then-current billing period. You can manage or cancel your Subscription through your Apple or Google account settings. Deleting your account in the Application does not automatically cancel your Subscription.
Free Trials and Promotions: If we offer a free trial, discount, or promotion, the terms will be presented at checkout. Unless stated otherwise, free trials convert to a paid Subscription at the end of the trial period unless you cancel before the trial ends.
Refunds: Refund requests are handled by the app store under its policies. We cannot issue refunds for purchases processed by Apple or Google.
Chargebacks and Abuse: If you initiate a chargeback or otherwise dispute a payment with your payment provider or app store, we may suspend or restrict access to premium features and, where appropriate, suspend your account to prevent fraud and abuse, subject to applicable law.
User Content and Publishing
The Application may allow you to create content such as calendars, milestones, time tracking entries, and other information you submit or generate ("User Content"). You retain your rights in your User Content, subject to the license you grant below.
Publishing: If you choose to publish a calendar, the published page may be accessible to other users or the public. Public fields may include your calendar title, description, life expectancy value, publication date, engagement counters (such as likes and views), and any milestones you choose to include, and may include your display name if you choose to provide one. We implement technical measures intended to prevent indexing of published pages by search engines, but we cannot control third-party behavior once content is shared.
Public-by-Link: Published calendars are accessible without login to anyone who has the link. If you share a published link, you understand that it can be forwarded, copied, or reposted by recipients, and you are responsible for deciding what information to publish.
License to Operate the Service: You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt (for formatting), transmit, and display your User Content solely as necessary to operate, maintain, secure, and improve the Application and to provide the features you request (including publishing and sharing).
Your Responsibilities: You are solely responsible for your User Content. You represent and warrant that you have all rights necessary to submit and publish the User Content and that it does not violate any law or any third-party rights.
Prohibited Content and Conduct: You must not publish, upload, transmit, or make available any User Content that is unlawful, infringing, defamatory, harassing, hateful, violent, sexually explicit, deceptive, spam, or otherwise harmful, or that contains personal data of others without lawful basis and necessary permissions.
Moderation and Removal: We do not commit to pre-moderating User Content. We may review, remove, restrict access to, or disable User Content, and may suspend or terminate accounts, where we believe it is reasonably necessary to enforce these Terms, protect users, comply with law, or address security or abuse risks.
License and Acceptable Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Application for your personal, non-commercial use. No rights are granted to you except as expressly stated.
You agree not to (and not to assist anyone to):
- Copy, modify, distribute, sell, or lease any part of the Application, except as permitted by law
- Reverse engineer, decompile, or attempt to extract source code, except where prohibited by law
- Access or use the Application in a way intended to avoid paying fees or to circumvent feature restrictions
- Use bots, scrapers, or automated means to access, collect data from, or interact with the Application
- Interfere with or disrupt the Application, networks, or security measures
- Attempt to gain unauthorized access to accounts, systems, or data
- Use the Application for unlawful purposes or in violation of applicable law
If you violate these restrictions, we may suspend or terminate your access as described in these Terms.
Technical Requirements and Offline Functionality
The Application is designed to support offline-first usage for many core features. However, an internet connection is required for certain functionality, including account authentication, subscription verification, publishing, and synchronization (where available).
We do not guarantee uninterrupted availability of online features. Maintenance, outages, or third-party service failures may affect availability.
Intellectual Property
The Application, including its software, design, user interface, text, graphics, logos, trademarks, and all related intellectual property, is owned by the Developer or its licensors and is protected by applicable intellectual property laws.
Nothing in these Terms transfers any ownership rights to you. You may not use our trademarks or branding without our prior written permission.
Copyright and Intellectual Property Complaints
If you believe that content in the Application infringes your copyright or other intellectual property rights, you may contact us at [email protected] with sufficient information to identify the material and your rights. We may remove or restrict access to allegedly infringing material and may take action against repeat infringers where appropriate and permitted by applicable law.
Important Disclaimers
Life Expectancy Features
IMPORTANT: Any life expectancy estimation features and results are provided for informational and entertainment purposes only and are not medical advice, health recommendations, diagnosis, treatment, or professional services. Results are based on generalized algorithms and assumptions and may be inaccurate.
You should consult qualified professionals for medical, legal, financial, or other advice. You use such features at your own risk.
Third-Party Services and Platform Terms
The Application relies on third-party services and platforms, which may include:
- Google Firebase (Authentication, Storage, Analytics, Crashlytics, Remote Config, Performance Monitoring)
- Microsoft Azure (hosting and backend infrastructure)
- RevenueCat (subscription status and entitlements)
- Apple App Store and Google Play (billing and distribution)
Third-party services are subject to their own terms. We encourage you to review them:
Apple-Specific Terms: If you use the iOS Application, you acknowledge that these Terms are between you and the Developer, not Apple. Apple has no obligation to provide maintenance or support for the Application. To the extent permitted by law, Apple is not responsible for any claims relating to the Application, including product liability, failure to conform to legal requirements, or intellectual property infringement. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Termination and Account Deletion
You may stop using the Application at any time. You may delete your account using the Application features (where available). Account deletion is intended to be permanent, and we do not restore deleted accounts.
We may suspend or terminate your access to the Application, or remove or restrict User Content, if we reasonably believe you violated these Terms, used the Application in a harmful or unlawful manner, or if it is necessary to protect the Application, users, or third parties, or to comply with legal obligations.
Where reasonably feasible and required by applicable law, we will provide notice of material enforcement actions (for example, an in-app notice), but we may act immediately without notice where necessary (for example, to address security risks, fraud, or illegal content).
Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Application, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any law or third-party rights. This indemnity does not apply to the extent a claim is caused by our willful misconduct.
Limitation of Liability
To the maximum extent permitted by applicable law, the Developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or related to your use of the Application, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total liability for any claim arising out of or relating to these Terms or the Application will not exceed the total amount you paid to the Developer for the Application in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, certain consumer rights, or liability for death or personal injury caused by negligence, or for fraud or willful misconduct, where applicable).
Disclaimers
The Application is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, we disclaim all warranties and conditions, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Application will be uninterrupted, secure, or error-free, or that any outputs (including calculations) will be accurate or reliable. Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.
Governing Law and Jurisdiction
These Terms are governed by the laws of Poland, without regard to conflict of laws principles.
If you are a consumer in the European Economic Area (EEA), the United Kingdom, or Switzerland, you may benefit from mandatory consumer protection laws of your country of residence, and nothing in these Terms limits your right to bring proceedings in the courts of your country of residence where such rights are mandatory.
Dispute Resolution
Before starting formal proceedings, you agree to try to resolve any dispute informally by contacting us at [email protected] and providing a description of the issue. We will make reasonable efforts to respond within a reasonable time.
EEA/UK/CH Consumers: If you are a consumer in the EEA/UK/Switzerland, you may have the right to use an alternative dispute resolution (ADR) entity, and you may also be able to submit a complaint via the EU Online Dispute Resolution platform (where available): https://ec.europa.eu/consumers/odr.
Except where mandatory consumer law provides otherwise, disputes not resolved informally will be brought in the competent courts in Poland.
Consumer Rights and Legal Notices
Consumer Rights
If you are a consumer, you may have mandatory rights under applicable consumer protection laws (including in the EU and certain U.S. states). Nothing in these Terms limits those mandatory rights.
Sanctions and Export Controls
You represent that you are not located in a country subject to comprehensive sanctions or embargoes, and you are not listed on any restricted party list. You agree not to use the Application in violation of applicable export control or sanctions laws.
Severability and Miscellaneous
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
No waiver of any term will be deemed a further or continuing waiver of such term or any other term.
We will not be responsible for any delay or failure to perform resulting from causes beyond our reasonable control (for example, third-party outages, network failures, natural disasters, pandemics, war, terrorism, riots, labor disputes, or governmental actions).
We may assign these Terms and our rights and obligations to an affiliate or in connection with a merger, acquisition, sale of assets, or by operation of law. You may not assign these Terms without our prior written consent.
These Terms constitute the entire agreement between you and the Developer regarding the Application and supersede any prior or contemporaneous agreements or understandings.
Language and Translation
These Terms are provided in English. If we provide translations, the English version will prevail in the event of any conflict, to the extent permitted by applicable law.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will provide notice by updating this page and the "Last updated" date, and where reasonably feasible by additional notice (for example, via an in-app notice). Changes apply from the effective date stated in the updated Terms.
